High court judge Samuel Mungali heard that on April 13, 2018, the five (two girls and three boys) were caught engaging in sexual activities at Bulesa area in Merti, Isiolo County.
The suspects denied the charge.
One of the two girls produced her birth certificate, which showed she was a minor. She was, consequently, freed on bond.
One of the boys was freed after his family paid a bond of Ksh50, 000.
The other three remain held up at an Isiolo Town police post until their ages are established.
Judge Mungali ordered Isiolo OCS and county children’s officer to ensure that the three suspect’s ages are proven; and a report issued to him on Friday, April 20.
The two suspects, who were acquitted, paid a bond of Ksh50, 000 each and a surety of similar amount or cash bail of Ksh30, 000.
The case will be heard on April 20.
